Rose’s Lawyers Ask Delay in Any Disciplinary Action

Pete Rose’s lawyers asked a federal judge Monday in Columbus, Ohio, to delay any disciplinary action against the Cincinnati manager while a dispute over his suit against baseball is being resolved.
Robert G. Stachler filed the motion minutes after an hourlong, closed-door meeting with U.S. District Judge John Holschuh and attorneys for baseball commissioner Bart Giamatti.
Stachler’s motion came one week after Holschuh ruled that Rose’s suit against Giamatti belongs in federal rather than state court.
In state court, Rose gained a temporary order protecting him from being fired or other possible disciplinary action by Giamatti resulting from baseball’s gambling investigation. In his ruling last week, Holschuh extended those protections until Aug. 14.
In his new motion, Stachler asked for an order that would delay a scheduled Aug. 17 meeting with Giamatti. Stachler also requested a stay in all further proceedings in the case because “the pressing issue to be resolved is federal jurisdiction, not the substantive merits of the controversy between the parties.”
Holschuh did not rule on the motion.
