DANA POINT : Control of Private Park to Be Weighed

The City Council will be asked to give its blessing tonight to an ownership transfer of a private park run by Dana Point homeowners to a local park district.
Council members will consider whether to support passing control of Dana Woods Community Park to the Capistrano Bay Park and Recreation District.
Members of the Dana Woods Homeowners Assn. vigorously oppose the deed transfer, saying they fear the Capistrano district would open the park to the public. Association board members say a public park would increase vandalism at the Dana Woods facility.
Association members, feeling that the city would be more sensitive to their plight, are expected to fill council chambers to ask the council to take control of the park.
However, City Atty. Jerry Patterson last week told the council in a staff report that state law would require that the park be deeded to the recreation district.
Association board members say their lawyer disputes the city attorney’s findings.
