SOUTHLAND : Mistrial in Rape at Kinison Home

With jurors deadlocked, a mistrial was declared today in the case of a man accused of raping comedian Sam Kinison’s girlfriend in the entertainer’s Hollywood Hills home.
The defendant, Unway Carter, 22, testified during his trial that he and the alleged victim had sex by mutual consent June 21 after Kinison hired him as a bodyguard for the night.
On its third day of deliberations, the Superior Court jury hearing the case deadlocked on three counts of rape and one count each of rape with a foreign object and forcible oral copulation.
Prosecutors did not immediately decide whether to retry the 6-foot-5, 300-pound Carter, who remains in custody in lieu of $100,000 bail.
