Empire State Building Lease Upheld

NEW YORK — Donald Trump’s Empire State Partners has lost a round in its court fight to seize ownership of the landmark Empire State Building in Manhattan.
Empire State Building Associates, headed by Peter L. Malkin, and Empire State Building Co., controlled by Leona Helmsley, sued Trump and his partnership in 1995. That suit sought to stop the Trump partnership from challenging Malkin and Helmsley’s control of the 102-story skyscraper.
Judge Edward Lehner said in a ruling Wednesday that Trump cannot terminate the leases right now. Malkin’s group controls the 114-year master lease, and Helmsley’s, the sublease. Trump’s Empire State Partners has been trying to seize control of the master lease since 1994, alleging that the building is mismanaged.
