The city on Wednesday will file a motion to dismiss the lawsuit brought against it by the Lake Mission Viejo Assn.
The lawsuit, filed July 1, challenges the validity of a law passed to preserve public views of the lake from Alicia Parkway.
The motion asks the court to dismiss the case on the grounds that the lawsuit was not filed and served to the city within 90 days of the adoption of the law.
The city ordinance restricts the height of the landscaping on a portion of the association’s property that borders Alicia Parkway.
